DECLARATION OF
RESIDENTIAL RESTRICTIVE COVENANTS,
CONDITIONS AND RESTRICTION
FOR
BLUEJAY PARK SUBDIVISION
CITY OF CORVALLIS, BENTON COUNTY. OREGON
These residential restrictive covenants, conditions and restrictions
for Bluejay Park Subdivision are to insure the use of the property for
attractive single-family residential purposes only, to prevent
nuisances, to prevent the impairment of the attractiveness of the
property, to maintain the desired tone of the community, and thereby to
secure to each site owner the full benefit and enjoyment of undisturbed
use of his site. Anything tending to detract from the attractiveness of
the property and its value for residential purposes will not be
permitted.
LAND USE AND BUILDING TYPE
No lot shall be used except for single-family residential purposes. No
building shall be erected. altered. placed or permitted to remain on
any lot other than one single-family dwelling not to exceed two and
one-half stories in height or 30 feet from plate sill.
An accessory building containing less than 300 square fret will be
allowed provided it is located more than 30 fret from a street line and
is separate from the residence by at least five (5) feet. Accessory
buildings are to be construed as buildings needed for the keeping of a
patio area, garden house storage or other like structure. Such
structure must generally conform to the architectural design and finish
of the home proper and may not be used for living purposes. All such
structures must be completed and painted within six months of first
construction.
CONSTRUCTION STANDARDS AND QUALITY
All construction shall be equal to the minimum requirements of the
Federal Housing Administration and in accordance with the Building Code
of the City of Corvallis. All dwellings shall be built (stick framed)
on site. No manufactured housing in any form will be permitted.
The ground floor area of the main structure, exclusive of one story
open porches and garage. shall not be less than 1000 square feet for a
one story single-family dwelling, not less than 500 square feet per
unit for the ground floor area of a single-family of more than one
story.
or planted and grown subsequent thereto, including the planting area on
public land adjacent to each property. Only ornamental plantings shall
be maintained on public land.
All fencing shall be cedar and have a maximum height of six feet and
absolutely no wire fence of any kind shall be permitted. If a fence is
used for pet containment. it shall be screened from view from adjacent
and other properties located in the subdivision.
VEHICLES
Parking of boats, trailers, motorcycles, trucks, junk cars, or other
equipment of a type not normally used for family transportation shall
not be allowed on any part of the said property nor on public ways
adjacent thereto excepting only within the confines of the enclosed
garage or a fully screened parking area. The term "oil' type not
normally used by family transportation" includes campers, other
vehicles and other equipment primarily used for camping, recreation, or
overnight accommodations. Trucks, trailers, campers, motor homes,
moving vans, and pickup coaches remaining within the area between the
front building line and the property line for not more than 24 hours
duration for loading and unloading personal goods or supplies will not
be in violation of these restrictions'.
LIVESTOCK AND POULTRY
Dogs, cats, or other household pets maybe kept provided they are not
kept, bred or maintained for any commercial purpose. No other animals,
livestock or poultry of any kind shall be raised, bred or kept on any
lot.
GARBAGE AND REFUSE DISPOSAL
No lot shall be used or maintained as a dumping ground for rubbish.
Trash, garbage or other waste shall not be kept except in sanitary
containers. All incinerators or other equipment for the storage or
disposal of such material shall be kept in a clean and salary condition.
SATELLITE DISHES AND RADIO ANTENNAS
Satellite dishes and radio antennas shall only be allowed within the
confines of the ran yard, provided it is screened and not visible from
the street or neighbor's yard,
TERM
The covenants and restrictions of the Declaration shall run with and
bind the land, and shall inure to the benefit of and be enforceable by
the owner of any lot subject to this Declaration, their respective
legal representatives, heirs, successors and assigns for a term of
twenty-five (25) years from the date this Declaration is recorded,
after which time
EASEMENTS
Easements for installation and maintenance of utilities, landscaping
and/or drainage facilities are reserved as shown on the recorded plat.
With these easements, no structure. planting or other material shall be
placed or permitted to remain which may damage or interfere with the
installation and maintenance of utilities, or which may change the
direction of flow of drainage channels in the easements, or which may
obstruct or retard the flow of water through drainage channels in the
easements. The easement area of each lot and all improvements in it
shall be maintained continuously by the owner of the lot, except for
those improvements for which a public authority or utility company is
responsible.
NUISANCES
No noxious or offensive activity shall be carried on upon any lot nor
shall anything be done thereon which may be or may become an annoyance
or nuisance to the neighborhood.
TEMPORARY STRUCTURES
No structure of a temporary character, trailer, basement, tent, shack,
garage, or other outbuilding shall be used on any lot at any time as a
residence either temporarily or permanently.
OTHER
Purchaser should realize that Steller Drive and Partridge Drive may
someday be extender SIGNS
No sign of any kind shall be displayed to the public view on any lot
except one professional sign of not more than one square foot, one sign
of not more than five square feet advertising the property for sale or
rent, one sign used by a builder to advertise the property during the
construction and sales period or political signs no larger than
eighteen inches by twenty-four inches provided they are displayed only
during the applicable times permitted by Oregon Election Laws. A
Bluejay Park sign identifying the subdivision is an exception.
LANDSCAPING
Each properly owner shall be responsible for maintaining and keeping in
good order the
condition and repair of all trees and plantings existing on said lots
at the time of purchase
said covenants shall be automatically extended for successive periods
often (10) years. Any of the covenants and restrictions of this
Declaration may be amended by an instrument signed by sixty percent
(60%) of the lot owners.
ENFORCEMENT
Enforcement shall be by proceedings at law or in equity against any
person or persons violating or attempting to violate any covenant,
either to restrain violation or to recover damages.
SEVERABILITY
Invalidation of any one of these covenants by judgment or court order
shall in no way affect any of the other provisions which shall remain
in full force and effect.

RESTRICTIVE COVENANT AGREEING TO PARTICIPATE IN FUTURE SIDEWALK
INPROVEMENTS
The undersigned, being the legal owners of the real property described
below, do hereby agree to participate in future sidewalk improvements
along internal street frontages.
The covenants herein contained shall be binding and effective for forty
years from the date hereof; provided, however, that the City of
Corvallis shall have the right to extend the covenants for an
additional forty years by recording a notice of such extension in the
deed records of the County prior to the expiration of the first forty
year period.
Sidewalks along the frontage of all streets within the property
described below shall be constructed on each lot, prior to the issuance
of a certificate of occupancy from the City of Corvallis for that lot.
In addition, if the undersigned or their successors in interest sell
any lot in the property described below, a sidewalk along the street
frontage for that lot shall be constructed within three years from the
date of sale:
