DECLARATION OF COVENANTS
AND RESTRICTIONS
Barley Hill Subdivision Phase II
to the City of Corvallis,
Benton County, Oregon
Now, therefore, declarant hereby declares that the purpose of these
covenants and restrictions is to insure the use of the property for
attractive single-family residential purposes only, to prevent
nuisances, to prevent the impairment of the attractiveness of the
property, to maintain the desired tone of the community, and thereby to
secure to each siteowner the full benefit and enjoyment of his home
with no greater restrictions upon the free and undisturbed use of his
site than is necessary to insure the same advantages to the other site
owners. Anything tending to detract from the attractiveness of the
property and its value for residential purposes will not be permitted.
LAND USE AND BUILDING TYPE
No lot shall be used except for single-family residential purposes and
must contain 4500 or more square feet. No building shall be erected,
altered, placed or permitted to remain on any lot other than one
detached single-family dwelling not to exceed two and one-half stories
in height or 30 feet from plate to sill.
An accessory building containing less than 300 square feet will be
allowed provided it is located more than 30 feet from a street line and
is separate from the residence by at least five (5) feet. Accessory
buildings are to be construed as buildings needed for the keeping of a
swimming area, boat storage structure, patio area, or other like
structure. Such structure must generally conform to the architectural
design and finish of the home proper and may not be used for living
purposes. All such structures must be completed and painted within six
months of first construction.
DWELLING QUALITY AND SIZE
It is the intention and purpose of the covenant to assure that all
dwellings shall be of a quality of workmanship and materials
substantially the same or better than that which can be produced on the
date these covenants are recorded at the minimum cost stated herein for
the minimum nP,-mirroA
dwelling size. All dwellings shall be built (stick framed) on site. No
manufactured housing in any form will be permitted.
The ground floor area of the main structure, exclusive of one story
open porches and garage, shall be not less than 800 square feet for a
one story single-family dwelling, not less than 500 square feet per
unit for the ground floor area of a single-family of more than one
story.
EASEMENTS
Easements for installation and maintenance of utilities, landscaping
and/or drainage facilities are reserved as shown on the recorded plat.
Within these easements, no structure, or other material shall be placed
or permitted to remain which may damage or interfere with the
installation and maintenance of utilities, or which may change the
direction of flow of drainage channels in the easements, or which may
obstruct or retard the flow of water through drainage channels in the
easements. The easement area of each lot and all improvements in it
shall be maintained continuously by the owner of the lot, except for
those improvements for which a public authority or utility company is
responsible.
NUISANCES
No noxious or offensive activity shall be carried on upon any lot nor
shall anything be done thereon which may be or may become an annoyance
or nuisance to the neighborhood.
TEMPORARY STRUCTURES
No structure of a temporary character, trailer, basement, tent, shack,
garage, or other outbuilding shall be used on any lot at any time as a
residence either temporarily or permanently.
SIGNS
No sign of any kind shall be displayed to the public view on any lot
except one professional sign of not more than one square foot, one sign
of not more than five square feet advertising the property for sale or
rent, or sign used by a builder to advertise the property during the
construction and sales period.
LANDSCAPING
Each property owner shall be responsible for maintaining and keeping in
good order the condition and repair of all trees and plantings existing
on said lots and abutting easements and right-of-ways at the time of
purchase or planted and grown subsequent thereto, including the
planting area along Barley Hill Drive, and the bike/pedestrian pathways.
FENCING
All fencing shall be cedar and have a maximum height of six feet and
absolutely no wire fence of any kind shall be permitted. If a fence is
used for pet containment, it shall be screened from view from adjacent
and other properties located in the subdivision.
VEHICLES
Parking of boats, trailers, motorcycles, trucks, junk cars, or other
equipment of a type not normally used for family transportation shall
not be allowed on any part of the said property nor on public ways
adjacent thereto excepting only in rear yard within the confines of the
enclosed garage or a behind a 6 (six) foot fence. The term "of a type
not normally used by family transportation" includes campers, other
vehicles and other equipment primarily used for camping, recreation, or
overnight accommodations. Trucks, trailers, campers, motor homes,
moving vans, and pickup coaches remaining within the area between the
front building line and the property line for not more than 24 hours
duration for loading and unloading personal goods or supplies will not
be in violation of these restrictions.
LIVESTOCK AND POULTRY
Dogs, cats, or other household pets may be kept provided they are not
kept, bred or maintained for any commercial purpose. No other animals,
livestock or poultry of any kind shall be raised, bred or kept on any
lot.
GARBAGE AND REFUSE DISPOSAL
No lot shall be used or maintained as a dumping ground for rubbish.
Trash, garbage or other waste shall not be kept except in sanitary
containers. All incinerators or other equipment for the storage or
disposal of such material shall be kept in a clean and sanitary
condition.
SATELLITE DISHES & RADIO ANTENNAS
Satellite dishes and radio antennas shall only be allowed within the
confines of the rear yard, provided it is screened and not visible from
the street or neighbor's yard. An 18" (eighteen inch) or smaller dish
may be mounted on roof area if it is black in color.
TERM
The covenants and restrictions of the Declaration shall run with and
bind the land, and shall inure to the benefit of and be enforceable by
the owner of any lot subject to this Declaration, their respective
legal representatives, heirs, successors and assigns for a term of
twenty-five (25) years from the date this Declaration is recorded,
after which time said covenants shall be automatically extended for
successive periods of ten (10) years. Any of the covenants and
restrictions of this Declaration may be amended by an instrument signed
by sixty percent of the lot owners.
ENFORCEMENT
Enforcement shall be by proceedings at law or in equity against any
person or persons violating or attempting to violate any covenant.
either to restrain violation or to recover damages.
SEVERABILITY
Invalidation of any one of these covenants by judgment or court order
shall in no way affect any of the other provisions which shall remain
in full force and effect.

RESTRICTIVE COVENANT AGREEING TO PARTICIPATE IN FUTURE SIDEWALK
IMPROVEMENTS
The undersigned, being the legal owners of the real property described
below, do hereby agree to participate in future sidewalk improvements
along internal street frontages.
The covenants herein contained shall be binding and effective for forty
years from the date hereof; provided, however, that the City of
Corvallis shall have the right to extend the covenants for an
additional forty years by recording a notice of such extension in the
deed records of the County prior to the expiration of the first forty
year period.
Sidewalks along the frontage of all streets within the property
described below shall be constructed on each lot, prior to the issuance
of a certificate of occupancy from the City of Corvallis for that lot.
In addition, if the undersigned or their successors in interest sell
any lot in the property described below, a sidewalk along the street
frontage for that lot shall be constructed within three years from the
date of sale.
The property subject to these covenants is described as follows:

These covenants shall be binding upon the undersigned and upon all
subsequent owners of the said property as covenants running with . the
land, to be released only by said City.
