DECLARATION OF RESTRICTIONS

THE PUBLIC

W. Whitney Ball and Jane F. Ball, husband and wife, James W. Ball and Joyce E. Ball, husband and wife, Noel I. Banks and Orpha E. Banks, husband and wife, Virgil Banks, a single man, and J. E. McEldowney and Anita McEldowney, husband and wife, hereinafter called "declarants", do certify and declare that the following conditions and restric­tions shall become and are hereby made, a part of all conveyances of the property with-in Ball-Banks Addition in Corvallis, Benton County, Oregon for a period of thirty (30) years from January 1, 1967.

1. No building site shall be used except for residential purposes. No dwelling or building which has previously occupied another site in or outside this subdivision may be placed or erected upon any building site. No building shall be erected, al­tered, placed, or permitted to remain on any building site other than one detached single family dwelling not to exceed two stories in height from the highest natural grade elevation immediately adjacent to the foundation of said structure, and a pri­vate garage for not more than two cars.

2. The locations of all buildings on building sites shall be in conformity with RI residential zone requirements of the City of Corvallis as the same exists as of the date of these presents except where these presents shall be more restrictive than the said zoning requirements. Front setbacks shall be 25 feet, side lot line 8 feet and rear yard 25 feet on interior lots.

3. No noxious or offensive trade or occupation shall be carried on upon any building site, nor shall anything be done thereon which may be or become an annoyance to the neighborhood.

4. No trailer, tent, shack, garage, barn, or other outbuilding shall at any time be used for human habitation, temporarily or permanently, nor shall any structure of a temporary character be used for human habitation.

5. No building shall be permitted on any building site covered by this declaration the main ground floor area of the main structure of which, exclusive of basement, eaves, steps, one-story porches, and garages, shall be less than 1,200 square feet for a one-story structure, or less than 850 square' feet for a two-story dwelling, or less than 850 square feet for a one-story dwelling having a daylight basement. A daylight basement is defined as the lower floor of a dwelling of more than one floor, in which at least a substantial horizontal length of the longest wall of said floor shall be entirely above finish grade. It is further understood that if an equivalent
substantial part of a wall of said floor is entirely above grade finish the lower floor shall be considered as a daylight basement. Said exposed daylight basement walls are to present an appearance equivalent to that expected of other above-finish grade walls under the terms and intent of this declaration, but need not necessarily be constructed of the same materials.

6. No animals or poultry of any kind, other than house pets, shall be kept or main­tained on any part of said property.

7. No fence, wall or hedge over thirty-six (36) inches in height shall be permitted to extend beyond the minimum set-back lines established herein, nor shall any fence, wall, hedge or mass planting over six (6) feet in height be erected, planted, placed or allowed to remain on any other part of the property except upon approval of the adjoining property owners.

8. All buildings in this subdivision shall be constructed in a good and workmanlike manner, and all exterior aspects of any structure provided for these conditions and restrictions must be completed within one (1) year from the beginning of construction.

9. Building site, as herein used, is defined as one lot or one lot and a portion of one or more lots in contiguous ownership.

10. Nothing herein contained shall be construed to prevent the use as one building site of two or more lots, or the use as a building site of portions of two or more lots, having a street frontage or not less than any lot a portion of which is in­cluded in such site.

11. Each and all of said conditions and restrictions herein contained shall be deemed and considered to be covenants running with the land and shall extend to and include the heirs, assigns, devisees, lessees and holders of every kind of and under all who may purchase or acquire any real property in said tract, and if the declarants or any of the property owners in said Ball-Banks Addition violates, or attempts to violate any of the conditions and restrictions contained herein it shall be lawful for any person in this subdivision to prosecute any proceedings in either law or equity against the person or persons violating, or attempting to violate, such conditions and restrictions, and in the event of such suit or proceedings the plaintiff therein shall be entitled to judgment for such damages as he may have sustained by reason of a breach of said conditions and restriction, and besides rendering judgment for dam-ages, costs and attorney's fees the court shall order a discontinuance of said viola-' tion. However, the lien of any mortgage shall not be impaired by reason of such violation.

12. In case of a conflict between these restrictions and the City of Corvallis Zoning Ordinance the more restrictive shall prevail.‑

IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and seals the day and year written below.

Dedication

Know all men by these presents that we W. Whitney Ball and Jane F. Ball, husband and wife, James W. Ball and Joyce E. Ball, husband and wife, Noel I. Banks and Orpha E. Banks, husband and wife and Virgil Banks proprietors and owners of the lands described and shown hereon, have caused this land to be surveyed and platted as shown hereon and hereby dedicate to the public use forever without reservation or restriction the streets and shown hereon.

In witness hereof, we do hereby set our hands and seals this 16th day of September 1965.
