ADAIR MEADOWS AND FIRST ADDITION
TO
BENTON COUNTY, OREGON

1. All lots in the tract shall be designated as residential lots without exception. No structure shall be erected, altered, placed or permitted to remain on any residential building lot other than single and duplex family dwellings not to exceed 2 stories in height, and other outbuildings incidental to use of the lot.

 

2. No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more than five square feet advertising the property for sale or rent, or signs used by a developer to advertise the property during the construction and sales period.

 

3. No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot, except that dogs, cats or other household pets may be kept, provided that they are not kept, bred, or main­tained for any commercial purpose.

 

4. No lot shall be used or maintained, as a dumping ground for rubbish, trash, garbage or any other waste shall not be kept except in sanitary containers. All incinerators or other equipment for the storage or disposal of such material shall be kept in a clean and sanitary condition.

 

5. No individual sewage disposal system shall be permitted on any lot unless such system is designed, located and constructed in accordance with the requirements, standards and recommendations of health authorities. Approval of such system, as installed, shall be obtained from such authority.

 

6. No fence, wall, hedge or shrub planting which obstructs sight lines at elevations between 2 and 6 feet above the roadways shall be placed or permitted to remain on any corner lot within the triangular area formed by the street property lines and line con­necting them at points 25 feet from the intersection of the street lines, or in the case of a rounded property corner from the inter-section of the street property lines extended. The same sight line limitations shall apply on any lot within 10 feet from the intersection of a street property line within the edge of a drive-way or alley pavement. No tree shall be permitted to remain with-in such distance of such intersections unless the foliage line is maintained at sufficient height to prevent obstructions of such lines.

 

7. No noxious or offensive conditions shall be permitted upon any lot nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood.

 

8. No trailer, basement, tent, garage, barn, shack or other out-building erected in the Addition shall at any time be used as a residence temporarily or permanently nor shall any structure of a temporary character be used as a residence. 

 

9. No structure, activity or equipment, shall be erected, pursued, or stored on or in any lot, having to do with mining, quarrying, drilling, or other industrial activity of any kind, nor shall any commercial structure or activity of any kind be allowed. This paragraph shall not apply to any commercial use hereinafter approved by the Benton County Planning Commission.

 

10. The developer shall cause to be formed in due course an Oregon nonprofit corporation bearing the name of Adair Meadows Home Owners Association, or similar name, which association shall cause to be enacted certain bylaws which shall be placed of record in Benton County, Oregon, and which bylaws shall be binding upon all persons claiming by, through or under the dedicator to the same effect as if set forth herein.

 

11. All conveyance of land situated in the Addition made by the Dedicator, and by all persons claiming by, through, or under the Dedicator shall be subject to the foregoing restrictions, conditions and covenants, whether or not the same be expressed in the instruments of conveyance.

 

12. These covenants shall be binding on all persons claiming under them until January 1, 1984; at which time said covenants shall be automatically extended for successive periods of 10 years, unless by vote of a majority of the then owners of the lots it is agreed to change said covenant in whole or in part.

 

13. If the Dedicator, her successors or assigns shall violate or attempt to violate any of the covenants herein it shall be lawful for any other person or persons owing any real property situated in said development to prosecute any proceedings in law or in equity against said person or persons violating or attempting to violate any such covenants and either to prevent him or them from so doing or to recover damages or other dues for such violations.

 

14. Invalidation of any one of these covenants by judgment or court order shall in no wise affect any of the other provisions which shall remain in full force and effect

The Adair Meadows Home Owners Association, that is listed on the deeds for property in the City of Adair Village disbanded around 1978. For some reason it was not removed from the deeds at the time of disbandment.
